James (Jim) McFarland

James (Jim) McFarland has been practicing law for over forty years. Jim has experience in both in-house and outside counsel positions with large and mid-size firms. Jim has experience in both domestic and international IP planning, patent preparation and prosecution and has been in-house counsel at a Fortune 500 Company and at the Lawrence Livermore National Laboratory. Jim was also a name partner in the law firm of Anderson, Dungey & McFarland for several years. Jim’s undergraduate degree is a Bachelor of Science in Electrical Engineering (BSEE) from the University of California San Diego (UCSD) and holds a Juris Doctorate degree from the University of Florida School of Law. Jim also has a Bachelor of Arts (BA) in economics from the University of Florida.

Practice Specialties

Patent preparation, prosecution, client counseling, licensing settlements and other intellectual property transactional matters, opinions for: infringement, validity, patentability and right-to-use, trademark prosecution and litigation related matters, and copyright matters. Jim’s technical expertise includes:

Telecommunications – extensive knowledge of 4G and 5G systems, base station design, 4G and 5G network core design, and artificial intelligence as particularly applied to communications systems.

Circuit Design – integrated circuit design systems, including automated design tools such as electronic design automation systems.

Global Positioning Systems – GPS handset and infrastructure design and E911, including preparing and prosecuting many of the patents that current protect the position location capabilities of current cellular phones.

Laser systems – including systems used industrial and medical applications.

Optical Systems – including optical devices and image processors.

Microprocessor Design – including hardware and software inventions.

Medical Devices – Imaging, laser treatment systems, joint replacements, etc. and many other areas.

Jim is admitted to the California Bar, the Florida Bar and is licensed as a patent attorney to practice before the U.S. Patent and Trademark Office.

Experience

With over 40 years of experience in law on top of his BSEE specializing in Communications and Laser Technology and his BA in Economics. Jim has managed and mentored many attorneys over his years of practice and represented and counseled clients of all sizes, including both start-ups with tight budgets and the largest corporations in America. During Jim’s time with one of the preeminent law firms in the San Francisco Bay Area, Jim managed a successful corporate mentor program to train client’s computer engineers that aspired to become patent attorneys.
